动漫卡通形象的知识产权法保护分析

动画产业是指以设计、制作、制作、销售、人员培训为产业链的二维动画、线上动画、影视动画、游戏动画、衍生产品开发产业。它是一个文化、艺术和现代科技高度融合的新兴产业。动漫产业是一个蕴含着巨大能量的产业，发展好的动漫产业往往能为一个国家带来收益。对中国来说，动漫产业有较好的市场空间，但中国动漫产业发展的过程中也出现了很多的问题。基于上述背景，中国动漫产业的发展需要知识产权的法律保护。本文通过对动漫产业的比较研究和国外动漫产业的保护，为中国动漫产业走出困境提出了一些建议。

ABSTRACT:Animation industry refers to the design, manufacture, production, sales, and cultivation of talents for the industry chain of 2 d and 3 d animation, web animation, film and television animation, game animation derivative product development and inheritance, culture, art and the modern science and technology are highly combined with the new industry, animation industry is a contains a huge energy industry, develop good animation industry often can bring benefits for a country. In China, the animation industry is a new industry, and there is good market space in China, but there are many problems in the development of Chinese animation industry.With the above background, the development of Chinese animation industry still needs the legal protection of intellectual property rights. This paper is to make Suggestions for the animation industry to get out of the predicament by comparing and studying the protection of animation industry from abroad.
