经济法视角下长生生物疫苗事件的思考

长春长生疫苗不合格事件在引起了社会各界的广泛关注、成为舆论焦点后，除了对“疫苗事件”表示愤怒和痛心外，本案的发展进程、处理结果等问题也一直被社会公众所关心。涉事的长春长生生物公司生产的数十万疫苗已经出售并且注入婴儿和成年人体内，事关身体健康安全，无论是劣质疫苗直接会伤害身体，还是因疫苗“失效”阻碍了身体本该获得的正常免疫而导致疾病的发生，都会令社会公众感到忧心和不安。目前，防疫部门已及时组织相关专家和医疗人员对问题疫苗进行防疫评估，根据接种记录观察并排查人员，为他们提供免费的咨询、检验和补种服务工作，打消公众疑虑，减少恐慌，确保民众的身体健康安全。笔者为应对疫苗事件并避免类似事件再次发生，结合此次事件所带来的警示，在本论文中提出了一些反思与建议。如何应对此次长春长生生物疫苗不合格事件、对此次事件做出怎样的姿态、如何把此次事故对公众的伤害降到最低，不仅具有理论意义上的秩序价值、正义价值、人权价值，而且对于我国疫苗方向立法的全面发展来说，也有着重要且紧迫的现实意义。
本文共分为三个部分，第一部分首先通过介绍长春长生疫苗案的案情和疫苗的相关知识，重点分析我国现有疫苗制度的现状以及药品犯罪背后所凸显的立法缺陷。第二部分进而结合经济法基本理论客观分析事实，通过对疫苗的科技化监管机制、供应链追溯机制、惩治力度、企业的道德教育等方面反思我国现有制度。最后第三部分对如何完善提出了建议，以达到避免此类事件再次发生的目的。

Abstract
Changchun Changsheng vaccine unqualified incident in the community has aroused widespread concern and become the focus of public opinion, in addition to the "vaccine incident" expressed anger and sorrow, the development process of this case, the outcome of the treatment and other issues have been concerned by the public. At present, the epidemic prevention Department has promptly organized relevant experts and medical personnel to carry out epidemic prevention assessment of the problem vaccine, according to the vaccination records to observe and check personnel, to provide them with free counselling, testing and replanting services, to dispel public misgivings, reduce panic, to ensure the health and safety of the population. How to deal with the Changchun longevity biological vaccine unqualified incident, what kind of posture to make this incident, how to minimize the harm of the accident to the public, not only has the theoretical sense of order value, justice value, human rights value, but also for China's vaccine direction of the overall development of legislation, Also has important and urgent practical significance.
This paper is divided into three parts, the first part firstly through the introduction of Changchun Changsheng vaccine case and the relevant knowledge of vaccines, focusing on the analysis of China's existing vaccine system status and drug crime behind the legislative defects highlighted. The second part, combined with the basic theory of economic law, objectively analyzes the facts and reflects on the existing system of our country through the scientific and technological supervision mechanism of the vaccine, the traceability mechanism of the supply chain, the punishment strength and the moral education of the enterprise. Finally, the third part puts forward some suggestions on how to perfect, in order to avoid the purpose of avoiding the recurrence of such events.
