行政给付是解决社会贫困问题的重要手段，也是政府的职责所在。在构建和谐社会的今天，行政给付的意义更为重大。但是，作为一个新兴的和亟需拓展的行政领域，行政给付行为理论和法律制度还很薄弱，其中最突出的表现就是行政给付程序短缺，包括行政给付程序理论研究滞后和立法缺失，加强行政给付程序研究已是当务之急。
本文将在分析中外行政给付程序制度的基础上提出我国行政给付程序完善的建议。绪论部分简述了本文的选题背景及选题意义，介绍了国内外研究状况，说明了本文使用的研究方法及研究手段，并概括了本文的创新之处。本文的正文内容共分为三个部分，第一部分，详细阐述了行政给付程序的基本理论，包括行政给付程序化的内涵，必要性，及其基本要求。第二部分，采用实证分析的方法考察我国的行政给付程序现状，指出了行政给付程序在立法规范方面的缺失，以及行政给付理论制度研究的严重滞后；第三部分，对目前我国行政给付程序存在的主要问题提出相对应的解决方案，首先转变思想认识，其次参照国内外相关领域立法经验，设立严格的行政给付程序，横向从简易程序和一般给付程序着手完善，纵向关注行政给付设定程序、行政给付作为程序、行政给付变动程序的细节完善，最后对行政给付程序中的主要程序制度作出了比较借鉴。随着20世纪福利国家的出现，我国关于行政给付的立法规范却多散见于社会保障法规中，程序法规范更是极度匮乏，基本上处于空白状态，这不利于行政给付的良性发展，本文将从行政给付程序的基本理论制度探讨如何规范完善行政给付的程序法制度。

Administrative benefit is an important mode to solve the social problem of poverty and also the responsibility of the government. Nowadays,its significance is more important in the establishment of harmonious society.However,as a new and being expanding area of administrative,administrative supply behavior behavior theory and the legal system is weak.One of the most prominent manifestation is the shortage of administrative payment procedures,including the procedure theory and legislative missing.Strengthen the administrative procedures of payment is now urgent. This article will analyze the system and foreign administrative payment process based on the payment of Administrative Procedure for perfect proposal. . The preface briefly states the background and significance of the seleeted subjects of this paper，introduces our country and foreign countries' research status，presents research methodology and research tools，and at last surnrnarizes this paper's innovation.There are total three parts of this text:The first part elaborats the basic theory of administrative payment process,including meaning, necessity, and basic requirements. The second part applies empirie alanalysis to investigate the benefits of our administrative system,indicating that the administrative procedure is in the lack of legislative norms and the theory of the system of administrative benefit serious lag。The third part provides the corresponding solutions to the main problems existing in our current administrative benefit system by changing our thinking and understanding first,the learning from foeign and abroad expriences in the relevant fields.Set up strict procedures for administrative benefit.In horizontal,pay attention to the perfectiong of summary and general payment procedures;Concerned about the administrative benefits of vertical setup process, as the administrative payment process, changes in administrative procedures for payment details of sound.Finally, make a comparison of reference of the main administrative procedures for payment procedure .
