随着法治社会的不断进步，我国在高等教育领域越来越倡导高等教育的法制化。
高校管理是高等教育的重要组成部分，而高校学生处分权又是高校管理权中的重要内容。因此，用法律手段规范高校学生处分行为是推进高等教育法制化进程的应有之义。从目前的实际情况来看，众多大学生状告高校的案例引起学界及社会对于高校管理及高校处分学生中法律问题的关注。本文试图通过对高校处分学生中的法律问题进行研究，论证高校到底有无权利处分学生、高校学生处分权到底多大多广、高校处分学生应当遵循怎样的法律程序及学生合法权益的法律救济等问题，以达到用法律武器规范高校学生处分行为，维护大学生合法权益，明确高等教育法制化发展方向之目的。

With the improvement of our nomocracy society, we start to realize the importance of the foundation of legal system in high education. College and university administration is an important part of high education, while the right to punish students plays an important role in college and university administration. We should insure that the punishment which colleges and universities give to their students is legal, so as to completely establish legal system in high education. Nowadays, more and more cases related to high school draw our attention. This article analyses colleges and universities have or not the right to punish their students, shows the limits of the right that colleges and universities have to punish students, proposes the procedure which colleges and universities should observe in punishing their students, then elaborates the remedy that students could take when their legal rights are invaded. The article tries to research legal issue in colleges and universities’ publishing their students, with the purpose of standardizing the punishment to high school students with law, protecting students’ right to receive an education, finding a right way to establish legal system in high education.
