随着我国经济的飞速发展，房地产业在带动中国经济发展的过程中起到了举足轻重的作用，也对每个人的生活产生了重要的影响，所以营造一个正常有序的房地产交易环境是意义重大的。
但是目前的房地产业交易过程中的欺诈行为日益显现在人们眼前，而且房地产购销欺诈行为的表现形式也是非常多样。针对房地产购销过程中欺诈行为的现状及表现形式，消费者根据我国的《消费者权益保护法》及其有关法律规定进行维权和寻求法律保护。2003年6月1日起施行的《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》对严重违反诚实信用的欺诈行为等做了更加详细的说明，更是对房地产市场的规范起到了推动作用。国家为了防止那些不符合标准的企业进入房地产市场，从制度上加以严格控制，按照《房地产开发企业资质管理规定》予以降级或注销其资质证书，使具有较强经营能力和经济实力的房地产开发企业脱颖而出。但是由于我国房地产法律起步晚，在商品房销售广告制度、房地产市场信息披露制度、商品房预售制度和房地产行政执法监管制度等方面还存在不完善的地方，本文针对以上内容提出了相关的建议。希望国家越来越完善的法律制度能够让强大的、关系民生的房地产行业朝着有序、健康的方向发展，使房地产行业在中国经济快速发展的道路上发挥更大的支柱推动作用。

The process for buying and selling real estate fraud in the form of the status and performance of the consumer according to China's "Consumer Protection Law" and its relevant laws and seek legal protection for rights protection. June 1, 2003 shall come into force of the "Supreme People's Court on the Trial of Disputes of real estate sale of several explanations" for serious violations and fraud in good faith to do a more detailed explanation, is the property market played a role in promoting norms. States that do not meet the standards in order to prevent the enterprise into the real estate market, a system should be strictly controlled in accordance with the "Real Estate Development Enterprise Qualifications," to be demoted or cancellation of its qualification certificate, so that stronger management capacity and economic strength of the housing real estate development business stand out. However, late start because the real estate law, sales of commercial ads in the system, the real estate market information disclosure system, the system real estate sale and real estate administrative and law enforcement supervision system and so there are imperfections, this paper put forward the above, the related proposal. Hope that more and more, a sound legal system that allows a strong bearing on the livelihood of the real estate industry toward the orderly and healthy development, so the real estate industry in China's rapid economic development on the road to play a greater role in promoting the pillars.
