中国现行的外贸代理制形式是以外贸经营权的备案登记制为基础建立的。
本文阐述了我国外贸代理制的发展变化和现存的问题，以及新《合同法》和国际条约对我国外贸代理的发展所起到的影响。本文分析了我国外贸代理制的现状与问题，提出了在WTO框架下推行外贸代理制的对策建议。

The China's present form of Foreign Trade Agency System is established according to Registration system of foreign trade rights.This thesis describes changes during the development and present problems of Foreign Trade Agency System, including the influences of New "contract law" and international treaties on the development of China's foreign trade agency agent industry. This thesis analyses the present status of China's Foreign Trade Agency System, and lists several methods and sugguestions to cope with the problem caused by the implement of Foreign Trade Agency System under the circumistance provided by WTO.
