网络技术的飞速发展，促进了信息传播和共享的速度，同时也给网络环境下的著作权保护带来了更大的挑战。
互联网的价值之一就是通过丰富的信息资源和信息共享，使社会公众获得更大的益处。由于网络数字化的特点,使网络作品极易被拷贝、传播、修改等,网络传输过程中又必然产生种种复制行为。著作权法对“合理使用”的相关规定在原则上均可以适用于网络环境下的著作权；但由于数字技术和互联网的飞速发展，新的作品使用方式的不断产生，著作权保护体系面临着调整与变革，为此应该合理调整作品创作者、传播者和使用者之间的冲突， 著作权的保护在网络环境下应该适当调整。合理使用制度是一个体现“衡平”精神的法律制度，她调节着著作权人、使用者乃至整个社会对知识资源的利用分配，然而同时她又是一个充满模糊和不确定因素的制度，使得在判定时常常和侵权不期而遇。于是如何界定合理使用和侵权就成为著作权领域的一个难题，同时又是一个不得不认真思考和解决的问题，因为其事关能否激励创新和丰富发展社会文化科技生活。

She adjusted the copyright owner, user and the whole society on the use of resources, however, and with a vague and uncertain factor in determining the system, which are often stunned and infringement.And how to define a reasonable and a copyright infringement in the field of a problem, and not to think seriously and solve the problem, because the matter could encourage innovation and technology development of social and cultural life.
