With the development of economic globalization, the translation of business contract is playing a more and more important role in international trade and the study of business contract translation has become an important subject for translators. However, the translation study still needs improving for the reason that in real practice, there exists inaccurate, unprofessional, mechanical and even wrong translation.The thesis tries to study the E-C translation of business contract from translator's perspective under the German functionalist translation theory. Itsuggests that translator should better recognize his role and then improve his literacy. Besides, the thesis also offers a solution for better translation, which is to limit translator's activity from three parts: source text producer, translation initiator and target text receiver.Key words: German functionalist theory; translator; source-text producer; translation initiator; target-text receiver

摘 要
随着全球经济一体化的不断发展，商务合同的翻译在国际贸易活动中发挥着越来越重要的作用，对商务合同翻译的研究已成为翻译工作者的一个重要课题。但是，在具体的合同翻译实践中也存在翻译不准确、不专业、机械翻译甚至误译等问题，造成翻译目的难以实践，因此，对商务合同翻译的研究仍有待深入。
本文尝试在德国功能主义学派的大背景下，从译者的角度来研究商务合同的英汉翻译。文中提出要加强译者角色的认知和素养的提高，并提出可以从三个方面限制译者的活动，即原文生产者、翻译发起者和译文接受者，以创造更加优秀的译文。
