目前在中国的农村，宅基地使用情况比较混乱，“宅基地超标，一户多宅，因继承而导致的宅基地闲置，城乡户籍迁移导致的宅基地闲置，农民外出打工造成宅基地季节性闲置”以及一户多处地基现象非常普遍，不利于节约土地资源，影响社会的可持续发展。本文首先简要回顾了我国现行法律法规对农村宅基地使用权流转的规定，并在理论层面上，对农村宅基地使用权流转的必要性进行了分析。在理论分析的基础上，通过对北京周边农村的走访，了解北京市郊区宅基地使用现状，并据此提出了现在存在的主要问题，结合案例分析，对农村宅基地使用权流转提出相应的建议措施。笔者认为解决这一问题的关键是让宅基地所有权和使用权分离, 并允许使用权自由流转。

Abstract
Currently the village in China, the house base uses a circumstance more confusion, "the house base super mark, a many houses, the house base causing because of inheriting is idle, the city country household register migration causes of the house base is idle, the farmer egress part-time job results in house base the seasonal is idle" and a several foundation phenomenon very universal, disadvantage in economy land resources, influence society of can keep on a development. This text the synopsis looked back the our country current law laws to flow to turn to the village house base usage power first of rules, and on the theories level, to village house the base use the power flowed the necessity turning to carry on analysis. The foundation analyzed in the theories up, pass for going and seeing peripheral village in Peking, understanding suburb area house base usage present condition in Peking, and on these grounds pose the key problem that exists now, combined case analysis, flow to turn to put forward homologous suggestion measure to the village house base usage power. I think that the key that works out this problem makes the house base ownership and usage power separated, and allow and use power and freely flow and turn.
