美国薪酬立法问题研究


【摘要】美国历史上秉持雇佣自由原则,可以自由协定劳动报酬。但由于经济和科学技术的发展,致使工作场所和劳动力不断发生变化,过度的市场调节有可能严重地损害劳动者的正常收入和产生社会问题。作为政府干预形式的薪酬立法对企业组织的薪酬决策产生重要的影响,也能为劳资双方创造一个有保障的工作环境和调节劳资关系,所有的薪酬实践活动同样也不能脱离法律的规制。美国薪酬立法的历史演变与其经济、政治、文化背景息息相关,其演变的特点也对薪酬的决策形成了多方面的影响。

【Abstract】In U.S. history, they uphold the principle of freedom of employment so that they can have free agreement on remuneration.The work place and labor force are changing with the develepment of the economic and science technology.But the market regulation somrtimes can have bad effects on workers’ income and lead on some social problems.As a form of government intervention, compensation legislation has important implications on compensation decision making.It can also regulate the relationship of employ persons and laborer to offer guaranteed work place.But all the activities of compensation decision making are limited by the acts. The hisory evolution of U.S. is closely related to its economic, polity and culture,and the features of the history evalution have many sides of implications on compensation decision making.
