新劳动合同法下的“过劳死”问题研究

摘   要

随着经济的不断发展，人们的生活水平不断提高，日常生活节奏日渐加快，给人们带来的却是无形的生活压力。近些年来，由于经济体制的转换和社会竞争的日趋激烈, 劳动者承担超负荷、超强度劳动的现象非常普遍。当劳动者创造社会财富和幸福生活的同时, 付出的代价却是自己身心健康的每况愈下, 甚至付出生命的代价。由于长时间过度劳累而造成的突然死亡，这就是过劳死。过劳死会严重损害劳动者及其家庭的利益，同时也会造成不良的社会影响。随着我国社会竞争的日益加剧，过劳死呈现出增长的趋势。因此，我们有必要重视过劳死这个问题，采取必要的措施去预防和减少过劳死的发生。
但是由于人们对过劳死问题认识不够以及制度上的缺失，无论是宪法、工伤保险条例还是新劳动合同法都没有涉及到有关过劳死的问题，对过劳死的法律上的防范和救济措施并没有明文规定，因此过度劳累损害员工的利益得不到法律上的保障。本文试图从对过劳死的原因分析，法律制度的盲区等来加以探讨,提出在应对过劳死问题上的对策建议，希望这为以后关于这方面的立法能有所稗益。

Abstract
With economy’s continued growth, people’s living of standard have improved, then the daily step becomes more and more quickly, but it brings about invisible living pressure for people. Recently, since economic system is changing and society compete becomes gradually fierce, it seems very common for labourer undertakes an excess load or an excess intensity . When labourer creates public wealth and a happy life , but the price paying is their physically and mentally health which is declining steadily ,even pays the life price . Because of tired excessively for a long time to bring about abruptness death , this are death from overwork. So death from overwork have seriously affected on the labourer and family’s benefit. Meanwhile it may bring bad effect on society. With society compete becomes more ficrce in our country, death from overwork displays the growing trend. So it is necessary for us to pay attention to this problem ,and then adopt some measure to take precautions against and fall off death from overwork's happening.
But people have little awareness to the death from overwork and also system hiatus, no matter what constitution, industrial injury insurance rules or new labour contract law does not deal with problem about death from overwork. Reply to the death from overwork which is on guard and relieve measure in law are not laid down officially. So excessive tired suffers labourer ‘s benefit which have no ensure in the law. The main body of a book is trying to analyse the cause of death from overwork , then discuss about the blind area of legal system , give the countermeasure and suggestion on answering the death from overwork problem . I hope that it can help the hereafter's legislation about this problem .
