农村集体建设用地使用权流转问题初探

摘要：我国法律规定农村集体所有建设用地不能直接进入土地的一级市场进行流转，但在社会实践中已经大量地存在，它是市场经济的必然选择。一些地方政府制定规范性文件规范其流转，却与现行法律规定存在矛盾冲突，导致农民的权益不能得到有效的保障。应结合我国农村集体建设用地使用权流转的现状，构建适合于我国农村集体建设用地使用权流转的法律制度。

关键词：农村集体建设用地；使用权流转；制度构建

Abstract：China's law in rural collective construction land can't directly enter the land of a market turnover,however in social practice there has been a lot of places,it is the inevitable choice of the market economySome local governments develop regulatory documents regulating their flow,but with the current law there is conflict,leading farmers can not effectively protect their interests .Should be in depth analysis of the rural collective construction land use right transfer to the status quo ,build rural collective construction land use right transfer of the legal system.
