论应用法定地役权说来解释相邻权的本质


摘要:相邻权是指不动产相邻各方为了自己不动产的利益和便利,而利用对方不动产的权利。对于相邻权本质的争议有两种观点,一种为所有权扩张与限制说,一种为法定地役权说。笔者认为所有权扩张与限制说无法很好地解释相邻权的问题,并且割裂了相邻关系与地役权二者间紧密的联系,忽略了二者在历史发展过程中的同源性。本文从地役权的起源、大陆法系国家或地区关于相邻关系的立法模式、两种学说所指称的具体权利结构和内容具有高度的一致性并均源于古罗马地役权制度、地役权本身权利结构适合调整相邻关系以及以所有权扩张与限制说解释相邻权本质存在的问题这五个方面来论证以法定地役权说解释相邻权本质更为科学严密,相邻权应定义为法定地役权。

From the origin of servitude and the mainland genealogy of law country or region of the legislation relating to the adjacency relation pattern.The two doctrines refers to the specific structure and content of rights have a high degree of consistency and have originated from ancient roman easement or right to adjust the structure itself, servitude and adjacent to the expansion and on the right to say nature is the right to explain the problems in the five aspects to demonstrate a legal right to explain the nature of servitude that is more scientific sound.
