对赃物是否适用善意取得制度
摘要：善意取得制度源于日耳曼法，是大陆法系与英美法系中一项重要的所有权制度，旨在保护善意第三人的合法利益，维护交易活动的动态安全。关于赃物是否适用善意取得制度，这是一个极具争议性的问题，我国在立法上予以了回避。本文通过对善意取得制度的法理研究，对赃物善意取得在各国立法中相关规定的分析，结合我国现的司法实践，以期更加理性来面对这一问题，构建最为合理、最适合我国国情的立法模式，既平衡所有权之动态利益与静态利益，又维护司法之正义。

Abstract：Good Faith comes from Germanic law, civil law and common law is an important title in the system, to protect the legitimate interests of bona fide third, to maintain trading activity of the dynamic security. Stolen goods in good faith on the applicability of the system, this is a very controversial issue, China has to be a evasive legislation. Based on the Good Faith of legal research on the stolen goods in good faith the relevant provisions in national legislation in the analysis of judicial practice in our country is to face this problem even more reason to build the most reasonable and best suited to national conditions of China's legislation mode, both the dynamic balance between the interests of ownership and static interests of justice and preserving the judicial.
