紧急状态下公民权利保障存在的问题及完善
摘要：虽然法治日益健全，但频繁发生的紧急事件，日益威胁着公民权利。紧急紧急状态下，为了维护公共利益和恢复公共秩序，政府权力的集中和扩大必然会导致公民权利受到更多限制和剥夺。为了保障公民的权利不因紧急状态的发生而被政府随意限制和剥夺，本文就我国紧急状态下公民权利保障存在的问题、紧急状态相关法律的修订制定、建立健全紧急状态下行政权力的监督制约机制、规范国家紧急权力的行使以及紧急状态下公民权利的程序保障进行阐述。

Abstract: The constitutionality is becoming more and more perfect, but the emergencies frequently occurred threat a lot to the civil rights. Under thest emergencies, in order to safeguard the public interests and restore the public order,the government concentrate the power and expand it at the same time;by this way,the rights of citizens will inevitably be  restricted and deprivated by the government. so,in order to protect the rights of citizens from being restricted and deprivated by the government under the emergencies,this paper concerns on the problems existting in the protection of civil rightsstate under emergencies in our country, and the development and amendments of related laws under emergencies, the establishment and improvement of the administrative power mechanism under emergencies to supervise over the Executive power, the regulation of the exertion of national emergencies powers, as well as the procedural safeguards of civil rights under emergencies.
