法律英语的模糊性
摘  要

该文主要就法律英语的模糊性的成因、积极作用以及其消极影响展开讨论。首先将其成因划分为客观因素和主观因素两个方面，并具体分析了客观成因的三个方面，即：语言自身的原因、法律规范概括性的特点和法律现象复杂性。接着，文章运用一系列例证对法律英语模糊性的积极作用进行了论证，认为它不仅可以满足立法的需要，使法律表达更为灵活，扩大法律的适用范围，实现法律的预见性，还可以体现法律的人文精神。另一方面，文章也分析了法律英语模糊性的消极影响，包括可能导致专制，模糊法律权利与义务的界限或造成法律适用上的不便等。

The Vagueness of Legal English
 
ABSTRACT
This paper mainly focuses on the causes in both the objective and subjective sides, the positive functions and the negative effects on the vagueness of legal English. In particular, the former includes the quality of language itself, the general nature of legal form and the complexity of legal phenomena. Then, the paper expounds the positive roles of the vagueness of legal English in some illustrations, stating that the positive roles can be divided into five parts: meeting the requirement of legislation, making the legal expression more flexible, enlarging the scope of application of law, realizing the farsightedness of law, and showing humanism of law. This paper also covers the negative effects of the vagueness of legal English, which includes the possibilities of causing autocracy, blurring the boundary line of right and duty, and causing inconvenience in application.
