法律文化差异在法律文本翻译中产生的误译及其解决方法
摘  要

随着全球化进程的加快，英语在各种国际交流中，尤其是法律文本翻译中越来越起到不可替代的作用。法律文本翻译中的问题也受到越来越多中国翻译工作者的关注。翻译不仅涉及语言问题，更涉及文化问题。本文作者认识到中西方文化差异对法律英语翻译具有重要的影响，法律文化的巨大差异使得法律文本中的源语言和译入语有时难以达到实质上的一致。所以，译者不仅要深入了解本民族法律文化，还要了解外国法律文化。本文中,作者从法律渊源、法律的物质基础、立法机制和法律体系等方面阐述了中西方法律文化差异产生的原因。从法律特殊词汇、法律短语和法律句子这三方面分别对法律英语中受法律文化差异的影响而误译的例子进行分析，揭示了法律文化差异在法律英语翻译过程中所起的作用。论文还运用转译、增译和释译两类方法解决误译问题,使汉语读者获得对法律英语原文的真实意义最贴切的理解。希望此项研究能提高译者对文化差异的重视程度,促进我国法律翻译事业的发展。

Mistranslations Caused by the Legal Cultural Differences in the Translation of Legal Texts and the Solving Scheme
 
ABSTRACT

With the rapid development of globalization, English is playing a more and more irreplaceable role in international communication, especially for the translation in the legal texts. Translation practicers and theorists in China have been paying attention to the issues in the translation of legal texts, while they are well aware that translation involves languages as well as culture. Similarly the writer of the present paper realizes that the differences between eastern and western culture have great effect on legal translation, which can be seen in the cases where a legal phenomenon in one language can hardly find its equivalent in another language. Thus the translators should be familiar with both the culture of the source language and that of the target language. In the thesis, the author analyzes the causes of legal culture differences from the aspects of history, material foundation, legal system and so on. In order to display the role that the legal culture differences play in legal English translation, the author also analyzes these mistranslations from the three perspectives as below: specialities in legal vocabulary, legal phrases and sentences. In addition, the author corrects the mistranslations through the ways of additional translation, transferred translation and paraphrase, in order that the readers can appropriately understand the true meanings of legal English. The purpose of the present research is to attract the attention of translators to the culture differences and to promote the development of our legal translation.
