劳务派遣行业发展研究

摘要

劳务派遣行业是中国现代市场的新兴行业，是现代人力资源服务业的一个重要组成部分，在中国的发展历史还不到十年时间，可以说，当代劳务派遣还只是处在该行业的初步发展时期，依然存在法律制度不完善、市场规则不规范、市场秩序混乱的局面，违法犯罪的案件层出不穷，对社会主义市场经济秩序以及劳动者的合法权益造成巨大的损害。这个局面在国家政府出台新的《劳动合同法》对该行业进行进一步规范及要求之后有所好转，但这种局面仍然存在，而且可能会维持好长一段时间。本课题正是基于此，从劳务派遣行业的发展模式进行深入研究，探讨该行业发展的社会必然性及趋势。
本文通过简要介绍劳务派遣的内涵、行业运行规则及与劳务派遣相关的用工方式，分析劳务派遣行业的发展背景与现状，归纳总结劳务派遣行业在中国内地存在的问题，从而预测劳务派遣行业的发展趋势，并提出促进劳务派遣行业发展的政策性建议。期望通过对劳务派遣行业的深入分析，掌握其发展规律和发展趋势，为行业的健康发展提供有益的理论借鉴。

Abstract
Labor dispatch industry is China's modern market and emerging industries, is a modern human resource service industry is an important part in China, the development history of less than ten years, can say, the labor dispatch is only in the initial period of development, still existing legal system is not perfect, non-standard, market rules market order is confused situation, the criminal cases emerge in an endless stream, on the order of the socialist market economy as well as the legitimate rights and interests of workers caused great damage. The sit- uation in the state government introduced the new" labor contract law" on the industry to further standardize and requirements better, but the situation still exists, but may be maintained for a long period of time. This paper is based on this just about, from the labor dispatching industry development mode to have thorough research, discuss the development of the industry of the social necessity and trend.
This paper briefly introduced the connotation of labor dispatch, labor dispatch industry operating rules and related employment mode, analysis of the labor dispatching industry development background and current situation, summed up the labor dispatching industry in mainland China the problems, thus predicting the labor dispatching industry development trend, put forward to promote the labor dispatching industry development policy recommendations. With the labor dispatch industry in-depth analysis, grasp the law of development and the trend, for the healthy development of the industry to provide useful theoretical reference.
