深圳市劳务派遣行业的调查研究

摘要

自《劳动合同法》颁布以来，企业的用工成本及用工风险都有所增加，给企业带来了管理和成本方面新的挑战。劳务派遣用工形式能有效合理、合法地将该系列用工风险释放或最低限度地降低用工单位的用工成本以及现实中或隐藏中的用工风险，受到企业的认可和广泛使用。近几年劳务派遣的飞速发展，肯定了这一用工模式，也从中产生了许多问题，各种劳务派遣的负面新闻频繁报道。相关的法律法规或条例并不完善，行业门槛低下，和该行业已经是一种泛滥的趋势，以致某些机构违法或违规操作危及到工人的利益。
本文研究主要对劳务派遣行业的现状进行调查研究，探讨了劳务派遣行业来自于市场的恶性循环效果、企业的违法违规操作、劳务派遣机构的违法违规行为、法律的漏洞等问题，并提出了提高劳务派遣公司的注册要求、完善劳务派遣管理办法和相应的法律法规、宏观调控劳务派遣公司、取消勤工俭学自由放任制度、建立工会等解决对策。旨在引起大家对劳务派遣行业的关注，加强大家对劳务派遣机构的认识，完善对该行业的管理办法，促进劳务派遣行业的健康发展。

Abstract

 Since the" labor contract law" enacted, labor cost for enterprises and employment risks have increased, was brought to the enterprise management and the cost of new challenges. The form of the labor dispatch can effectively and reasonably, the series of legitimate employment risk of release or minimally reduced labor unit labor costs as well as in reality or in the risk of employment, recognized and widely used by enterprises. In recent years, the rapid development of labor dispatching, affirmed this one mode that use worker worker, also from arising in many problems, all kinds of labor dispatch negative press frequently reported. Related laws or regulations are not perfect, industry doorsill is low, and the industry has been a trend of the spread, so that some organizations illegal or rule-breaking operations threaten the interests of workers.
This paper studies mainly on the labor dispatching industry present situation investigation and study, to explore the labor dispatch industry from market vicious spiral effect, the illegal operation, labor dispatch mechanism of illegal acts, the loopholes in the law wait for a problem, put forward to raise labor dispatch company registration requirements, improve labor dispatch management and the corresponding laws and regulations, macroscopical adjusting control labor dispatch company, cancel the work-study laissez-faire system, the establishment of trade unions and other countermeasures. To cause you to dispatch the attention of the industry, strengthen the labor dispatch of body awareness, improve the industry management approach, to promote the healthy development of labor dispatching industry.
