浅析刑罚功能的内容

摘  要 刑罚功能在刑罚学体系中占据着重要的地位，对它的认识、分析和评价不仅关系到刑罚理论体系的科学性 ,而且影响到刑罚实践的有效性。通过理论方面对刑罚的功的认识，以及对相关概念、学说进行分析比较，着重从相对科学的体系来认识刑罚的功能，从而加深理解刑罚功能的内涵，最后结合我国现代刑罚体系的现状提出完善刑罚功能的意见，以求从最大程度上实现刑罚的功能。

Analysis of the penalty function's contents

Abstract The penalty function is occupying the important status in the penalty study system, to its understanding, the analysis and the appraisal not only relates the penalty system info's scientific nature, moreover affects the validity which practices to the penalty. Through the theoretical side to penalty's merit's understanding, as well as to the related concept, the theory carries on the analysis comparison, knows penalty's function emphatically from the relative science's system, thus the deepening understanding penalty function's connotation, unifies our country modern penalty system's present situation to propose that finally consummates the penalty function the opinion, realizes penalty's function in order to from the greatest degree.
