摘要

    随着社会主义法制建设进程的快速发展，人们对精神生活的要求越来越高，隐私开始受到人们的重视，尤其是网络技术飞速发展的现代社会，互联网已经成为人们生活不可或缺的组成部分,网络信息越来越受到人们的关注，个人信息在网络传播，隐私信息在网络被非法利用早已不是什么新鲜事情。许多不法分子利用网络盗窃个人合法财产的行为层出不穷，严重侵犯了公民的合法权益，破坏了社会的安定。
伴随着盗用个人隐私信息事情的频繁发生，促使隐私权作为一种独立人格的权的呼声越来越大，加快制定隐私立法显得越来越重要，隐私权对于公民来说具有重大的意义，从各种各样侵犯公民隐私权案件的判决来看，我们可以看到一个事实，那就是隐私权已经再也不能零零散散的分散在《刑法》，《民法》，《民事诉讼法》等等法律当中，这样不仅不能有效的发挥隐私权的作用，而且不能及时的保护当事人的合法权益和社会的公平，隐私权应当有属于自己独立的位置，使得它更好的与知情权和其他权利加以区别，执法人员也能够更好的利用相关法律保障受害人的合法权益，使得法律更能发挥及时有效的作用。

Because the socialism legal system constructs the rapid development of progress, people's request to the spiritual life is more and more high,the right of privacy starts being valued by people, particularly is the modern that the network technique flies to soon develop society.Internet already become people living necessary thing, the network information is subjected to people's concern, personal information spreads in the network, and the privacy information is been no longer what fresh affair by the illegal exploitation in the network.Many illegal members make use of network thieves and burglars personal behavior of legal property to pile up one after another, seriously infringe upon the citizen's legal rights and break social stability.
Accompany with to appropriate personal privacy an information the multifarious occurrence of the affair, urge right of privacy as noise of shouting of power of independent character more and more big, strict of establishment right of privacy procedure of the utmost urgency, the right of privacy has a graveness to citizen of meaning, infringed upon a citizen from various each kind right of privacy the result of the case to see, we can see a fact, that is the right of privacy already any further not ability zero spread loose dispersion inpenal code,civil law ,code of civil procedures etc. among the law, so not only not ability effective of the function of the exertion right of privacy, and can not the legal rights and social equity of the protection the party concerned in time, the right of privacy should has the position to belong to oneself's independence and makes it better and knows what happened power and other right and takes into distinct,law enforcement official can also better the guarantee making use of related law victimize a person of legal rights, make the law can even develop an effective function in time.
