浅论行政立法中的公众参与

摘要:民主参与机制是行政立法程序的核心和精髓。行政立法程序中公众参与具有促进立法民主、实现人民主权、提高立法质量、推进法的实施以及适应WTO要求的重要价值。本文从介绍行政立法的基本概况入手，在对公众参与行政立法的理论基础和意义进行分析的基础上，指出当前我国行政立法程序中存在着法律制度不完善、行政机关漠视公民参与权、参与程序的可操作性不够、公民参与意识比较淡漠等问题。对此，必须加强立法、完善配套制度、转变行政机关观念、提高公民意识以及建立责任追究制，从而完善我国行政立法公众参与制度，以推动法治国家的建设。

Discussion of the Public Participation in Administrative Legislation
ABSTRACT : The democracy participation mechanism is the core and the essence of administrative legislative procedure.Public participation in administration legislative procedure can promote legislation democracy, realize the people’s sovereignty,enhance legislation quality,enforce the law as well as meet WTO request; This paper froms the start with the basic survey of administrative legislation,and points that currently there are some problems,such as perfect legal system,ignorance of the citizen’participation,insufficient participation procedure, faint participation of citizen and so on; It is necessary to strengthen the legislation,consummate system,transformation the idea of administrative organ,raise consciousness and responsibility of citizen, so to perfect public participation in administrative legislation and promote the rule of law nation-building.
