我国发展低碳经济的法律制度保障

摘  要：随着我国低碳经济发展的紧迫性，我国已经建立了许多的法律、法规及规章，为保障低碳经济健康发展提供了法律保障。但是在法律实施过程中，存在着有法不依、执法不严、违法不究的现状。为了能够很好的发展低碳经济，解决碳排放超标的法律执行力过软、执法过程中的徇私舞弊等问题，提出应加强发展低碳经济的法律惩处力度，只有改变法律对环境污染补偿性惩处，增加法律对环境污染惩罚性措施；加重针对超标碳排放的刑事、民事以及行政责任的惩罚力度。才能使各个主体增强环境保护责任意识，也能够增加高污染、高排放主体的污染成本，使污染主体主动减低污染排放，发展好低碳经济。

China's Development of the Legal System to Protect Low-carbon Economy
 
Abstract: With the Urgency of developing low-carbon economy ,it has been established a lot of laws in china. The law has provided protection for low-carbon economy. But it has failure to abide by lax enforcement of impunity in the course of law enforcement. In order to better development of low-carbon economy, it is important to strengthen the legal punishment. Only change the law on the environmental pollution compensatory punishment, increasing the punitive measures, that can increase the cost of the enterprise of which had been high pollution and high emission. Then the main contamination will reduce pollution emissions initiatively, and develop low-carbon economy well.
