论我国行政垄断的危害及对策

行政垄断的概念最早是由经济学研究者在二十世纪八十年代末提出的，作为一种特殊的垄断，其不是一个新鲜的话题，也不是我国特有的现象。所谓行政垄断，亦即运用行政权力对经济活动实施了排除或限制竞争的行为。新旧体制转变的不彻底、相关法律法规的不健全等问题都会导致行政垄的产生。而行政垄断所带来的负面影响也是死显而易见的，其危害性远甚于经济性垄断，它的存在严重地破坏了正常的市场竞争秩序、导致了贪污腐败现象的滋生、损害了消费者的权益、加剧了社会的不公，是与社会主义市场经济竞争原则根本抵触的。因此，基于对行政垄断定义和成因的理解，以及对其危害的综合分析，从而探究遏制行政垄断的有效途径。

On the administrative monopoly in china: its detriments and solutions
Abstract: The concept of administrative monopoly was first proposed by some economy researchers at the end of the 1980s. Administrative monopoly as a kind of special monopoly is neither a new topic nor a kind of characteristic phenomenon in china. It is but a kind of behavior that makes use of administrative power to exclude or limit competition in economic activities. Problems like incomplete transfer from old order to a new one, the lack of sound laws and regulations can become the very hotbed of administrative monopoly. And the detriments of administrative monopoly are quite obvious and much worse than economic monopoly, for it will greatly disturb the normal competition order of the market, brings about bribery and corruption, damage the basic rights of the consumers and worsen the social inequality issue, which are totally against the competition principles of our socialist market economy. Theretofore, based on the understanding of the definition and origins of administrative monopoly and the comprehensive analysis of its detriments, this thesis sets out to explore some sound solutions of administrative monopoly.
