论知识产权的利益平衡

知识产权法的调整对象是多元化的，不同利益主体之间对立又统一的复杂关系要求知识产权法必须具备一个平衡机制来协调知识产权法中的基本矛盾，以实现立法宗旨，促进人类文明的蓬勃发展。现实状态中知识产权保护存在失衡的情形，它不利于知识产品的传播与扩散, 加剧了发达国家与发展中国家的差距，因此，这就需要构建知识产权利益平衡机制。在构建利益平衡机制中需要把握其内涵、基本原则和总体要求，处理好几个层面的平衡关系。知识产权制度既应维护权利人的利益, 激发其创造热情, 又应对该权利加以必要的、适当的限制,保护社会公众的利益, 实现私人利益与社会公众利益间之间的平衡。

Study on Interest Balance in Intellectual Property 
Abstract: Adjusting object of intellectual property law is multiplex. The complex relations of the unity of opposites among different stakeholders require that intellectual property law should build up a balanced mechanism to coordinate the basic contradictions in the intellectual property law in order to realize the aim of legislation and promote the vigorous development of human civilization. There is disequilibrium in the protection of intellectual property in reality, which is really harmful to the dissemination and the proliferation of knowledge product and intensifies the disparity between the developed countries and the developing countries. Therefore, it is necessary to construct a balanced system of intellectual property interests. It needs to grasp its connotation, basic principles and general requirements, and deal with several aspects of the balanced relationship in constructing the benefits balance mechanism. The intellectual property rights system should not only maintain obligee's benefit and stimulate their enthusiasm of creation, but also provide the essential and suitable limit to the rights in order to protect the benefits of the public, and realize benefits balance between the private interests and the social public interests.
