结婚条件及其立法研究

自古以来，婚姻家庭关系就是民事关系的重要组成部分，而结婚条件的法律适用在其中占着整个体系举足轻重的地位。法律规定结婚应该具备的条件, 是国家对结婚这一法律行为进行管理和监督的重要手段和途径。结婚条件是婚姻成立不可缺少的要件，包括结婚的实质要件和形式要件。而我国《婚姻法》关于结婚条件的有些规定或过粗或缺乏正当性，本文通过对结婚条件的理论与实证分析，提出了完善我国结婚条件的立法建议: 以禁止性规定的方式来要求结婚的必备要件; 扩大禁止结婚的消极要件范围; 实行登记与仪式相结合的结婚程序; 增设结婚登记公告制度。

Study on the Marital Condition and Legislation

Abstract

From ancient times to the present, marriage and family relation is a significant part of civil relation, moreover, the application in law of the marriage condition now is occupying a crucial position in the whole system. The stipulation about what marriage should posses set by the government is an important means which is aim to administrate or supervise marriage such kind of legal act. Marriage documents (including the substantive important document and the formal important document) are indispensable elements which lead to the establishment of marriage. I put forward some legislative suggestions in order to improve our country’s marriage conditions in this article. They are: use the prohibitively stipulated manner to require the necessary conditions in a marriage; expand the scope of the negative elements of prohibitive marriage; put the marriage procedure which combines registration with ceremony into practice; put up additional system of marriage registration bulletin.
