从新《婚姻法》看法律英语之特点及翻译方法

随着中国改革开放的不断深入, 对外经济往来日益频繁,我国依法治国观念的不断深入及我国的各种涉外法律事务的逐渐增多，对外法律文化的交流日益频繁，法律翻译显得尤为重要，法律翻译研究的重要性也随着提高。 但就整体而言，我国法律翻译起步较晚，法律翻译尚未成熟，质量有待提高。
本文首先对新《婚姻法》及其英译本进行了深入的研究，然后详细阐述了功能对等理论的含义、发展和新《婚姻法》英译本的翻译与其的内在联系。最后本文深度解析了法律英语的词汇、语义、语法、结构特征及其翻译方法，以及从功能对等理论的角度研究法律翻译的方法。

                       Abstract

With the deep development of The Reform and Open policy in China, the legal English translation is of great significance and at the same time, the importance of the study on legal English is enhanced, on accounts that the exchange of foreign law culture enjoys a great popularity. Nevertheless, the progress of legal English in China lag behind, the development of it is not enough mature, and the quantity of it remains to be improved.    
This paper, to begin with, makes an intensive study of Marriage Law (2011) and its English version. Then the author elaborates the connotation and development of functional equivalence theory, studies English Version of Marriage Law (2011) ( hereinafter referred to as the new Marriage Law ) and the inner links among the theory and the version. Finally the paper deeply analyzes and demonstrates the features and translation methods of legal English, as well as the translation methods of the new Marriage Law from functional equivalence theory.
