中国古代的存留养亲制度研究

随着我国社会主义建设的不断发展，我国社会主义法制建设取得了十分重要的成就，但仍有许多不足之处。存留养亲制度是我国古代较为重要的法律制度，从北魏至清末共存续了一千四百多年，对封建社会的发展起到了巨大作用。存留养亲制度并非是对罪犯的姑息，而是对年老无依者的人情关怀，是儒家孝道精神的体现，尽管存留养亲制度在现代已无其存在的社会基础与思想基础，但这并不意味着其已失去社会价值。其在案件中考虑到了社会普遍认可的孝道思想，有利于社会的和谐稳定。因此，本文通过对存留养亲制度的研究，有利于为当今法制建设做出参考。

Study of the System of Permitting Culprit
To Support Lineal Elders
ABSTRACT:With the increasing development of Chinese socialist construction, Our country has made great achievements,but there are still have many shortcomings. Permitting Culprit To Support Lineal Elders was an important legal system in ancient China.From the Northern Wei Dynasty to the late Qing Dynasty，it had existed over 1400 years and had the great influence to the development of feudal society. Its essence is the care to the old instead of the appeasement of criminals. So, it is the embodiment of Confucian filial piety spirit. Although there are not social and ideological bases in this time, it does not mean that this system is not have social value.If we take the filial piety into account when we decide a case, it is benefit to the social harmony and stability. Therefore, this essay can promote today’ s construction of the legal system via the study of this system.
