电信诈骗对社会主义核心价值观的危害及其防治
电信诈骗，层出不穷，出现的越来越频繁，通常是借助手机、网络、银行卡等方式进行非面对面接触的诈骗犯罪，对国家、社会、个人的危害深远，当前，我国推出各项政策进行防治，现有做法的功效和缺陷也亟待探究。我国现行刑法并未对电信诈骗犯罪单独作出规定，由此导致司法实践中对该犯罪的评判标准不一致，进而出现适用混乱的现象，严重损害我国司法权威。《关于办理诈骗刑事案件具体应用法律若干问题的解释》对此类诈骗案件的法律应用进一步明确，但仅仅就在具体实践中在数额问题上做了一些相关规定，但是没有把电信诈骗犯罪这个罪名单独予以界定。本文通过深入分析其危害，结合当前已有的相应政策，制定出防治电信诈骗继续危害国家、社会、个人的措施。

Civil Litigation of Non Bis in Idem
Abstract: Telecom fraud, usually using network, mobile phones and credit cards, is a kind of non face-to-face fraud crime. Recently, this phenomenon has become more and more frequent, seriously endangering the state, society and individuals. The government has introduced policies to prevent and control the problem, but their effectiveness and limitations are urgently needed to be tested. Because the current criminal law of our country has not a special provision about the telecommunication fraud, it becomes difficult to unify the judgement standards, which causes uncertainty and chaos in practice. The situation seriously damages the judicial authority of our country. The application of the law has been defined further in [The Explanation about Some Problems in Specific Applications of the Law When Handling Criminal Cases of Fraud]. However, it only made some relevant provisions on the amount. It didn't define the crime of telecom fraud clearly. This article will analyze its hazards in depth, then combining the existing policies, work out appropriate measures to prevent telecom fraud from endangering the national, social and personal happiness.
