论“公共利益”的界定及其在行政征收中作用

近年来，随着我国经济的快速发展，以房地产为标志的一系列新兴产业蓬勃发展，带动了大量相关产业高速增长，是我国经济发展的重要引擎。但是，随着经济发展同时而来的是大量有关案件的井喷式爆发，尤其是政府强拆类型。很多此类案件中，政府打着“公共利益”的旗号，大肆侵犯公民的私人利益，引发社会的强烈关注。“公共利益”到底是怎样定义的，由谁定义，说法纷纭，在具体的实践操作中因为关于这一概念的模糊定义导致纠纷不在少数，大有成为经济发展桎梏的趋势，因此有必要对这一问题进行深入研究。本文以“公共利益“的定义为着眼点，围绕公共利益与公民私人权利保护这一核心问题展开讨论。综合各国立法现状，具体对“公共利益”定义主体、定义程序，以及二者与公民利益关系进行研究，并提出自己的相关建议，以期达到预定的研究目标。
