信用证融资的法律问题改革开放来，随着我国经济实力的飞速发展，全球化程度日益加深，进出口贸易迅猛发展，融资需求也与日俱增。信用证是国际贸易实践的产物，是一种贸易支付工具、结算手段、融资工具，从产生到形成国际惯例经历了漫长的过程，也获得了广泛的认同。信用证的出现不仅弥补了国际贸易领域不同国家间通用工具的制度空白，还在客观上促进了全球经济的发展。但不能否认的是，信用证在国际贸易发挥其积极作用同时，也客观存在着相关的法律风险，因此，以法律规范加以指引是很有必要的。由于商业银行存在固有的缺陷、进出口企业法律意识比较淡薄，在信用证融资的领域，信用证欺诈、信用证诈骗普遍困扰这些企业和银行，是信用证融资领域亟需解决的问题。结合该领域的立法现状，建立健全信用证融资领域的法律制度是解决该问题的有效途径。因此，本文的主要课题是在加深信用证融资原理研究的基础上，为我国信用证融资法律制度的完善提供有效的建设性建议，为该领域的制度完善以及国际贸易的健康发展提供有价值的法律指引。

As a result of the commercial bank has inherent defect, import and export enterprise legal consciousness is weak, in the field of credit financing, l/c fraud, fraud is generally the companies and bank of l/c, l/c is financing needs to solve the problem. Combined with the legislative status quo in this field, establishing and perfecting the credit financing in the field of legal system is an effective way to solve the problem.
