以危险方法危害公共安全罪的限制适用

高科技的迅速发展深刻的改变着人们的生活方式和生活质量，在给人们的生活带来便利的同时也带来了诸多风险。食品安全、飞车飙车、病毒横行等无时不刻不在刺痛着公众的神经，挑战着安全系统的极限。法律的滞后性也影响着人们无法有效及时的防范这些风险，用相对陈旧的法律应对“日新月异”的犯罪手段，难免有点力不从心。于是理论现实两种标准，不得已的扩大解释等问题层出不穷。出发点我们可以理解，出于对民众安全的负责和预防犯罪。但是显然面对法无明文不为罪的基本原则，又无法自圆其说，陷入僵局。本文以危险方法危害公共安全的理论到此罪的实践，列举了多种经典行为案例，意在能够明确该罪的内涵和外延，希望能更好的将此罪应用于实践。

The Restrictive Application of Crime of Endangering the Public Security with Dangerous Methods
   Abstract: The unbelievable rapid development of modern Science and technology has profoundly changed people’s lives,providing Conveniences which are not foreseeable in the past, and also created unprecedented risks. The Food safety, Speed racing, rampant and the virus does hurt the public's nerves, challenging the limits of the safety system. Law lag also affects the people can not prevent these risks effectively and timely , dealing with "ever-changing" criminal means with a relatively old law , inevitably a bit powerless. Because of the standard of theory and the reality, the expansion of last resort interpretation problems emerge frequently.we can understand the starting point, out of the people in charge of security and crime prevention.But obviously ,according to the fundamental principles of no clear stipulation not to be , they can not justify, caught. Based on the risk of endangering public security theory to the practice of this crime,enumerate the case of a variety of classical behavior,and intend to enable the clear connotation and extension of the crime, hoping to better practice.
