论劳动赔偿金制度


本文主要阐述了劳动赔偿金的法律特征,适用条件以及适用问题。对于用人单位的违法行为给劳动者造成损失的,如何最大程度保护劳动者合法权益和弥补所遭受的损失。对于劳动者的违法行为损害用人单位合法权益的,如何更合理的确认法定的赔偿责任,从而呼应倾斜保护原则,但实践中处于弱势地位的劳动者并没有得到很好的保障。现行《劳动合同法》中更多的规定用人单位的赔偿责任,而劳动者赔偿责任只占少部分。这看似合乎立法目的,但劳动者的赔偿责任却明显过大,对用人单位违法的惩罚效果欠缺。要怎样才能解决这一问题,对我国劳动关系和谐持续发展以及法制建设具有重大影响。
本文从劳动赔偿金的理论入手,通过分析劳动赔偿金的特点,对相关法律法规进行剖析,研究劳动双方对于赔偿金的适用情况。拟从三部分对分析赔偿金制度缺陷并提出完善建议,第一部分分为两方面。首先阐述赔偿金的含义,然后分析赔偿金的特点,通过研究赔偿金的特点,我们可以发现赔偿金对劳动双方具有不同的适用标准;第二部分是研究劳动双方对于赔偿金的适用条件,通过对相关法律法规的理论分析,分析劳动双方需要承担赔偿责任的必要条件;第三部分是通过以上论述得出的观点,对用人单位和劳动者的法定赔偿责任以及赔偿金的计算标准提出完善建议。

Abstract

This paper mainly about the characteristics of labor compensation law, as well as the application of the applicable conditions, for violations of the employer to the worker's loss, how to protect the legitimate rights and interests of workers and to compensate the loss suffered by the greatest extent, for illegal workers behavior causing loss to the employer, and how to be more reasonable to confirm the legal liability, thus echoing the tilt protection principles, disadvantaged workers in practice has not been well protected, the current "Labor Contract Law" provisions more the employer's liability, workers compensation and liability accounts for only a small part, this appears to be in line with the legislative intent, but the liability of workers is obviously too large penalties for employers of illegal lack of effect, how can we solve this problem , and the legal construction of the harmonious development of labor relations is of great significance.
This paper write from the labor theory of compensation, labor compensation by analyzing the characteristics of the relevant laws and regulations, analyze, study the application of labor compensation for the two sides, to be analyzed from three parts of the compensation system defects and make sound recommendations on part is divided into two areas, first expounded the meaning of compensation, and then analyze the characteristics of compensation, by studying the characteristics of compensation, we can see that both sides of the labor compensation have different standards apply. The second part is the study of labor conditions applicable to compensation for both sides, through the relevant laws and regulations of the theoretical analysis, analysis of labor both sides need to take the necessary conditions of liability. The third part is obtained by the above discussion points made recommendations for improving the legal standard of liability and compensation calculation employers and workers.
