论国家在反恐中的国际法责任
恐怖主义并不是一个新的国际现象，反恐活动也不是一个新的国际名词。在刚刚过去的20世纪国际社会恐怖活动的多发时期，也是国际社会为反对恐怖主义而积极探索的时期。震惊世界的“9.11”事件之后，国际恐怖主义进入一个全新时期，反恐活动也日益紧张激烈。以反对恐怖主义，先后进行了阿富汗战争和伊拉克战争。最近的索马里海盗事件后，根据国际公法的相关规定，包括中国在内的多个国家获得出兵索马里的授权。这一国际一致共同出兵反恐事件说明了恐怖主义是当前国际和平与安全的主要威胁，同时也彰显了国际社会反对恐怖主义的决心。但伴随着国际反恐向宽领域和深层次的发展，一系列的国际问题出现：国家在反恐活动中的权利界限，国家在反恐活动中的国际法律责任认定和法律责任的承担，等等复杂国际问题争端。在今天一个法制为主流的国际社会，面对反恐活动层出不穷的国际问题，作为国际法主体的国家在反恐中的国际法责任的困难变成了首要解决的问题。

Abstract:Terrorism is not a new international phenomenon, anti-terrorist activities were not a new international nouns. In just the past 20 century international social terrorist activities of the multiple times, it was the international community to fight terrorism and actively explore period. Shocked the world's "we-are-all-americans, international terrorism after entering into a new period, anti-terrorist activities also increasingly nervous fierce. Against terrorism, conducted a series of the war in Afghanistan and Iraq war.

But with international terrorism to wide field and deep development, a series of international problems in the war on terror: the national boundary, the country right in the war on terror international legal responsibility identification and liabilities of the international problems disputes, etc complex. Today a legal system for the mainstream of the international community, in the face of war on terror international problems emerge in endlessly, as the subject of international law in the state of international terrorism responsibility strandhard to become the first solve the problem.
