文艺作品在网络环境中的著作权保护

第一,分析文艺作品在网络环境中的侵权模式。文艺作品在网络中的表现形式为：汇聚了创造者思想的艺术表现经数字化的存在形式，追求的是著作权人和受用者的权益平衡。技术发达后文艺作品在网络上的侵权尤其严重，本文将文艺作品在网络中的侵权模式分为三种，复制侵权，发行侵权，篡改侵权。将三种侵权模式划定范围并且通过现有问题详细分析
第二, 分析我国文艺作品的网络著作权现状，从国内的侵权情况进行分析了解，再结合上文对提出的三种模式找到现有法律中相对应的管理方法，以及通过分析我国独特的司法保护了解国内诉讼情况，最后了解国外法律现状进行对比，简单分析国际条约对我国网络著作权立法影响。
第三, 通过前文了解到的问题现状和法律空白提出建议。就技术方面、程序方面、普及方面和国际方面四个方向提出建议，旨在平衡著作权人、网络服务提供商与使用者之间的权益关系，为文艺作品在网络中稳定持续发展创造良好环境，也需要社会关注和全民努力。

Abstact
First, analyze the infringement mode of literary and artistic works in the network environment. The expression of literary and artistic works in the network is: the digital existence form of the artistic expression of the creator's thought, and the pursuit of the balance of rights between the copyright owner and the user. After the technology is developed, the infringement of literary and artistic works on the Internet is particularly serious. This article divides the infringement mode of literary and artistic works in the network into three types, copying infringement, issuing infringement, and tampering with infringement. Divide the three infringement models and analyze them in detail through existing issues
Secondly, it analyzes the status quo of online copyright of Chinese literary and artistic works, analyzes and understands the domestic infringement situation, and then finds the corresponding management methods in the existing laws in combination with the three models proposed above, and analyzes the unique judicial protection of our country. Understand the situation of domestic litigation, finally understand the status quo of foreign laws, and briefly analyze the impact of international treaties on China's online copyright legislation.
Third, make recommendations through the status quo and legal gaps learned in the previous article. Advising on the technical, procedural, universal and international aspects, aiming to balance the rights and interests between copyright owners, network service providers and users, and create a good environment for the stable and sustainable development of literary and artistic works in the network. Social attention and national efforts are also needed.
