论检察机关的自由裁量权

检察机关通过起诉或不起诉控制着进入审判的入口，其自由裁量权的行使范围与实际应用都有不断扩大之势，且检察机关自由裁量权作为司法裁量权的重要组成部分越来越受到重视。与此相关的大部分文章都探讨了自由裁量权与检察机关自由裁量权的涵义，却没有明确界定二者，本文通过介绍各自的内涵，来对二者进行合理的界定，以明确二者的本质区别。一项权力、一个制度是否能有效服务于社会要看在实践中的运用，而这主要包括行使与制约问题，在检察机关自由裁量权的行使的过程中是否有被合理制约，对案件最终的结局有重要影响。再者，对案件受害人的事后救济也是我们应该更加重视的问题，本文对此做了探究，并对此提出了自己的一些见解，希望该项权力能被合理有效的运用到司法实践中。

Abstract
 The procuratorial organs control the entrance to the trial through prosecution or non-prosecution, and the exercise scope and practical application of their discretion are expanding continuously. And prosecutorial discretion as an important part of judicial discretion has been paid more and more attention. Most of the articles related to this have discussed the meaning of the discretion and the discretion of the procuratorial organs, but did not clearly define the two, this paper through the introduction of their respective connotation, to a reasonable definition of the two, in order to clarify the essential difference between the two. Whether a power and a system can effectively serve the society depends on its application in practice, which mainly includes the exercise and restriction issues. Whether it is reasonably restricted in the exercise of the prosecutorial discretion has an important impact on the final outcome of a case. In addition, we should pay more attention to the relief of the victims after the case. This paper has made an inquiry into this, and put forward some of their own opinions, hope that the power can be reasonably and effectively used in judicial practice.
