法文化差异对法律术语翻译的影响
本研究从法文化差异的角度来研究法律术语的翻译。随着中国对外交流的增多，在不同文化间的法律交流成为重要的一部分。为保证法律交流的成功，在翻译过程中，译者不仅需要纯属的源语言与目的语的转换技巧，更需要掌握充分的法律文化与法律知识。法律术语作为法律翻译的基础和核心，需要引起足够的关注。本文从法律术语翻译出发，探索了法律术语的词源与特征，以及作为法文化核心的中西法律体系与法律部门的差异，并指出了对法律翻译的影响。进而提出了法律翻译中源语言与目的语间三中不同的对应方式：邻近对应、部分对应、零对应。最后作者从归化、异化角度，分别分析了三种不同对应的解决方式。

The present study probes into the translation of legal terminology from the differences in legal culture. With the development of China’s external exchange, legal exchange has become more and more important. To make this exchange successful, the translator should not only grasp the translation skills in both source language and target language proficiently, but also a sound knowledge of legal culture and knowledge. As the foundation and core of legal translation, legal terminology should draw enough attention. From the perspective of legal terminology, the present study explores the sources and characteristics of legal terminology, and the difference between legal systems and branches, and their impacts on legal translation. And then the author put forward with three different kinds of equivalences between source language and target language, which are near equivalence, partial equivalence and non-equivalence. At last, corresponding methods have been come up with from the perspective of naturalization and foreignization.
